Legal Question in Personal Injury in Virginia

My Mercedes, 2009, E350, Sport package, 4matic, 12322 miles was hit by a State Farm (SF) insured driver (his fault) from behind that damaged my vehicle. SF paid $4,875 to repair my Mercedes. SF offered to pay me $2,100 for my vehicle diminished value. My vehicle valued was almost or about $39,000 before accidence according to KBB.com After accidence the Carmax only wanted to offer me only $30,000 when I took it to them. So the difference is $9,000. I asked the SF to pay me only $6.725 they declined. My question is do I file a lawsuit to against the SF or the SF insured driver? If I sued I sue for $9,000 I plan to hire a lawyer to represent myself, should I or I should not?.

You sue the at fault driver rather than his insurer and, yes, best to

have an attorney if you want to maximize your chances of winning the lawsuit.
