Negligence of a company employee
We have a brand new 2007 Trailblazer that got peppered by white industrial enamel paint. A maintenance man was spraying the inside of a car wash at a c store with white paint. Our vehicle was sitting outside and caught the overspray. He nor his boss did not come inside to ask that we move the vehicle because they would be painting. My partner found out about it when she went outside to go on her break. We were told to take it to a detail shop and see what they could do. They are going to use a clay rod to try to remove the specks and if that does not work then he said wet sand. We just made the 2nd or 3rd payment on this 40,000.oo vehicle. I am concerned about the warranty on the paint job after this is done and what it is going to look like in a few years. I took pics of the damage and filled out a damamge report with the comapny. My main question is do you think we have a chance to get the vehicle replaced since it was so new or how do you suggest we handle this situation?

I would say that your question regarding getting the vehicle replaced is at this point premature; better wait to see what it looks like after the repair job.
