My daughter was involoved in an automobile accident and sustained some minor injouries to neck and back. I am attempting to settle this claim with the insurance company. What kind of settlement should I expect. Her medical charges are around 1250.00 she's had one court appearance representing the state because the individual was dui she's a student who had to quit the track team and she has lost a coupe of days from work. They have already settle on the damage to her car which was around 1200.00

The 3 x the "meds" component to the victim's claim for damages referenced in the prior answer would be for the pain and suffering(trauma) which the victim presumably incurred (and endured) as a result of this accident.

Out of pocket expenses for the accident victim(including lost wages) + 3 x "the meds", meaning the medical expenses already incurred by the victim, as the jargon goes in these personal injury(PI) cases + an estimated allowance, if appropriate and reasonable, for any future therapy or treatment which the victim may require as a result of her injuries = one formula for settling these kinds of PI cases. Unfortunately, however, without an attorney negotiating in your daughter's behalf, the claims adjuster for the insurance carrier will almost always "low ball" any settlement offer to a non-attorney.
