Legal Question in Personal Injury in Virginia

personal injury/negligence by a resturant

While eating at an IHOP resturant, I bit into a chicken bone (even though the item was supposedly ''boneless''). My gum and mouth were injured. Is the chain responsible for costs incurred for medical care? The assistant manager and the server both were notified at the time of the inicident, and I have the bone in my possession. I am having pain in my mouth, and now it is going into my jaw. The corp. is giving me a ''run around'' about covering any dental exam or costs.

Re: personal injury/negligence by a resturant

Yes, if you can demonstrate by a preponderance of the evidence that the proximate(legal) cause of the injury described was the offending chicken bone, you should be able to recover your costs in small claims court if the IHOP folks continue to stone wall your claim(s).
