Legal Question in Personal Injury in Virginia

road funds

we live on a private road that is gravel and maintained by a road fund. there are residents on the road that say they will not pay because they can can get sued if someone gets hurt. can any person that pays into this fund be sued . if so would changing this to an llc help out

A question of primary importance would appear to be who (or what) actually owns the road and is therefore likely responsible for any injuries which may occur thereon? If each property owner whose land abuts the road is recorded in his or her deed as owning that part of the road or having an easement thereon, it's possible that whether he or she pays into the road maintenance fund may be entirely irrelevant to the issue of owner liability.
