Legal Question in Personal Injury in Virginia

A salaried manager at our restaurant who also is in charge of our schedule receives tips. She only receives tips on tables she works, but she schedules herself for private dinners where the server makes a ridiculous amount of money. In two shifts she has mad 1,000 dollars in tips. I know it is a huge moral issue, but is it illegal? She is listed as a manger.
