Legal Question in Personal Injury in Virginia

Can I sue for Emotional Distress / Mental Anguish Lawsuit in Virginia for someone lying on a application an obtaining a contractors license for his son to use? His son was a revoked contractor and has stolen my money. I am fighting him in court to get my money back. I have proven the licensing fraud and the license has been revoked. The father signed the admission of licensing fraud to the board of contractors and voluntarily gave up the license.

I have had many stress related illnesses this past year since this started.

The tort (civil wrong) you are referring to is known as the intentional infliction of

emotional distress. Under the facts described, it would be my assessment that any emotional distress from the licensing fraud matter which you may have suffered would not likely have been intentionally inflicted by this defendant(to the extent necessary to prove your claim) nor is it likely(in my opinion) that you would also be able to prove some kind of physically injurious impact that is normally also necessary for this kind of claim under Virginia law.
