What can I sue the parties involved for?

I was injured at Fort AP Hill, VA on Rapelling tower #3 Towers edge had wore PVC with no ''non slip'' material on pipe. Morning dew made it slick (permission to be there was also questionable)

The class I was taking was a ''high risk'' class in the NFPA Standard Operating Handbook a EMS unit MUST be on sceen. There was none. I laid on ground for a long period of time. once 1 arrived it was marked out of service for only having 3 brakes then i had to wait more for another to transport.

The SOP also stated that a certain Student to Instructor Ratio must be kept for saftey reasons.. that was not kept either.

My knee was tore up when I slipped from tower on april 8, 01 and lost all employment.Ive had 9 surgeries since and last was a full replacement. Hurts like hell.

do i have a case for neglect, pain and suffering or ?????

I was nice a first and tried to just get Work. Comp. but since I was a volunteer no good. My permanent job as a Medic at a jail was terminated because of the injury. I was given the choice quit or be terminated I have this all in writing. lots of photos and statements.

You would need to find a lawyer experienced in the Federal Tort Claims Act for injuries on federal property -- if you were in military service at the time you might be out of luck. Then again, you might not.

I just read the part about the injury occurring way back in '01. Why did you wait so long? You probably waited too long to sue, but see a FTCA lawyer in any event.

The people you can sue are:

1. The Army; that's difficult, because it requires a Federal Tort Claims Act suit, with a quite short statute of limitations (usually two years from the accident); when did this happen?

2. The instructors: were they DAC, regular civilian, or military? The answer to that question changes who you can sue and even where.

3. Manufacturer/builder/maintainer of the tower: This would be based on investigation to determine if the tower was in compliance with standards.

There may be others based on investigation.

What is for sure is that the severity of your injuries warrants investigation so you can determine if you have a case or not, and if so whether it is economically viable to pursue it.
