Time Limitations

How long after a non-reportible motor vehicle accident does the person not responsible for the accident have to claim injury?

Said person was not transported to a hospital at the time of the accident.

The statute of limitations in Virginia for personal injuries is two years. However, there are exceptions, so see a lawyer immediately if you were injured in a vehicle accident. There is no specific deadline other than the statute of limitations for making a claim against the other side's insurance co., but delay in asserting a claim can result in questions about the legitimacy of the claim. There may be shorter time limits in your own policy in the event that you have a claim against your own insurance.

There is a 2 year Statute of Limitations within which a lawsuit must be filed with a court (assuming this to be an accident which occureing within the Commonwealth of Virginia). The fact that there is no mention of any injury for some period of time is only evidence going to the severity of the injury or its causation as the result of the accident
