Legal Question in Personal Injury in Virginia
Warrant in debt
A person was shot by a bb gun in the arm. My boyfriend was found guilty of reckless handling of a firearm, received a fine and no jail time--name removed--no proof, no weapon, no nothing!) We received a warrant in debt, for $15,000, from the parents of the person hit with the bb. Can they do that and what are the chances they can get that money from us??

Re: Warrant in debt
If by your question you mean can these folks sue for damages, the answer is, yes, of course, they can. Whether they can win, however, is quite another matter and will almost certainly depend on a number and variety of factors which, among other things, the defendants named in this lawsuit should now be discussing with their attorney(s).
There is a clue, nevertheless, that may indicate that these suers have not really thought through and credibly itemized their recoverable damages which is indicated by the $15K which they are apparently seeking in damages. $15K is merely the so-called jurisdictional limit or maximum amount which one can sue for in the general district court, and those who have not clearly and persuasively calculated their recoverable damages simply list the jurisdictional limit in their pleadings for which they are unlikely ever to actually receive a judgment from the court even if they happen to "win" the case.
