Legal Question in Personal Injury in Virginia

My wife and i (from Ireland visting family) was hit while we were walking across the road today. We had to go to the hosiptal. Was told that the guy that hit us was charged with reckless driving and has to go to court in May. My question is that do we have to turn up to court for for? We were planning to fly home on the 15th on April.

Normally, when there has been property damage or personal injury resulting from a traffic accident in the Commonwealth, the victim is asked to appear at the scheduled hearing for the defendant in the matter.

However, in your case, you should probably contact the local Office of the Commonwealth's Attorney that is prosecuting the matter and explain that you're scheduled to fly back to Ireland on April 15th but that you would be willing to provide the Commonwealth with a statement as to any injuries/trauma that you may have incurred from this accident in lieu of your attending the hearing in May.
