Legal Question in Product Liability in Virginia

Are they liable to fix my car ?

My son-in-law owns a tire & auto bussiness and he got one of his hired help to replace my radeator. Was quoted over the phone that it may cost $400, so was pleased to only pay $189 when I picked it up, did not pay attention to the bill but the reason for the differance was that he did not charge me for labor. So have the car for 4 days and the motor ceases up and the motor has to be replaced, because the oil cooler line that attaches to the radeator came loose and pumped all the oil out of the motor. My question, is he responsible for this since he did not charge me for labor only for the radeator?

Re: Are they liable to fix my car ?

Yes, damages which can be traced to negligence on the part of the repair

person and which did not exist when

the vehicle was brought to the shop

should be recoverable from the business irrespective of what labor was previously charged for or not. (The court, however, might give the repair shop an offset for this uncharged labor if you were to sue in small claims court and recover damages.)
