Legal Question in Real Estate Law in Virginia

2 Closings .. No Home

I want to know if I have grounds to seek legal action:

1. I was told that i had been pre approved for a loan for 105,000 and to find a house .

2. I was scheduled to go to closing and received an e-mail the morning of to say that we were not going to closing because the broker did not have my paperwork completed.

3.A second closing was scheduled and at that time the broker made all involed aware that she did not have a loan for me .

4. Titles had already been done . In fact all the work necessary had been completed( apprasials/ title search/ inspection etc.)

I moved out of my apartment when we comfirmed the first closing day and now me and my child are homeless.....Meaning we have no where at all to live. I had all utilities transferred and active at the ''new home''. I did not have to come out of pocket with any monies however, I don't understand how this got this far without the loan .

Your main problem with respect to any legal action

which you might wish to pursue is that you most likely have nothing in writing to corroborate your claims or that there was even an enforceable contract between you and the broker.

In short, this would appear to be another version of the proverbial "she said v. she said" situation with nothing for you to hang a legal claim around, so to speak.
