accruing equity

I left my husband and moved out of the home we jointly own. If I do not want to fight him for my share of the equity, will I still accrue equity even if I don't live there or make the mortgage payments. For example, if in 10 years, we have $100,000 equity in the home, am I entitled to half of that in ten years, or am I only entitled to the equity in the house at the time I moved out?

Re: accruing equity

You may want to discuss your rights with your divorce attorney. From a purely real estate viewpoint, if your husband makes all the payments for the next ten years, he might argue that you should not receive any of the future equity. Often, these issues are addressed in a property settlement agreement.
