Legal Question in Real Estate Law in Virginia

Appliances/Real Estate Sale

The refrigerator in the house we sold did not convey per the contract, but I forgot to arrange for it to be moved out before the sale of the house. I am tryng to arrange to either pick up the refrigerator or have the house owners pay for the refrigerator, but they are unresponsive other than to have their real estate agent tell us that the matter is closed (i.e., the owners are keeping the refrigerator). The refrigerator was purchased two years ago for $1700.

Do I have the legal right to insist that I be allowed to retrieve the refrigerator? Small Claims court?

Yes, if you are in fact still the owner of the refrigerator, you can sue for its return by filing what's called a warrant in detinue in the general district court in the city or county where the property is located, requesting that the refrigerator be returned to you or, in the alternative, that you be awarded by the court a judgment against the wrongful withholder(s)in the amount of its fair market value.
