Legal Question in Real Estate Law in Virginia

my aunt passes away 2years ago. A neighbor fenced in approx 1/2 acre of her land and is letting his horses graze without consent from any of the family. What steps should I take to have him remove the fence?? Obvious answer is to demand he take the fence down. What will be my next step when he refuses?

You then take him to civil court to obtain an order requiring him to remove the fence and the horses from this property along with a judgment

for any damages incurred from this unauthorized activity.
