Breach of Contract

I am being sued by a contractor , claiming he completed the contract in full. He did not complete the contract and he ordered the wrong railing material. The material he ordered was not on the contract. I fired him and had another contractor complete the job. I am countersuing. Even though I gave him $8,000 will he be entitled to the other $4500 even though he did not complete the work? I have letters and emails of him saying he did not complete the work.

It will be your task to convince the court that the contractor did not complete the work that was required under the contract and, as these failures constituted material breache(s) of such contract, that he should not be awarded the damages which he's seeking.

The other major issue which the court apparently will need to consider was whether the work which the contractor did complete was worth the $8000 which you apparently paid for it, and, if not, then how much you should be awarded on your countersuit, if anything.
