Legal Question in Real Estate Law in Virginia

Common Areas

Good morning,

I just bought a condo house. In one of the rules and regulations states that we can't park water crafts or boats in any of the Common Areas. My question is; am I allowed to park my boat in my driveway? Nowhere in the rules and regs mention anything about driveways.

Thanks in advance

Re: Common Areas

Without reviewing these bylaws (not just the one which you've cited), as well as, perhaps, other related rules and/or regulations formally promulgated by the association, I don't see how one could reliably say one way or the other.

Re: Common Areas

It would be necessary to carefully read the entire thing. For example, the fact that you are not allowed to park it in common areas does NOT necessarily mean you ARE allowed to park in your driveway. It is a reasonable assumption. But you would have to carefully read the whole thing. Sometimes what one section giveth another section taketh away. But if that is the ONLY relevant reference, then I would say yes, you can park it on your own driveway. HOA's are always trying to enforce non-existent rules.
