Legal Question in Real Estate Law in Virginia

condo by-laws

I have gotten a letter from the board stating I have to remove an air conditioner from my bedroom window or I will be fined $10 a day. The by-laws do state that is against the rules. My unit was the ''model'' and the garage had been converted into an on site office when the units were built. It has carpet, walls, heat and air. The air conditioning unit is not large enough to cool 3 levels and I have had a unit in the window for 15 years. I had a verbal agreement with the builder/agency/management company (all the same person) that it could be installed. Also they have left me alone for 15 years. It sometimes reaches 90 degrees on the 3rd floor. Thanks

Re: condo by-laws

You can petition the board for an exception or waiver. However, if one is not granted, you must comply with their directive to remove the unit.
