Condominium Delivery
I signed a purchase agreement for a
condo in July 2005. In the
agreement is a stipulation that, if
delivery has not occured within 24
months of the date the agreement
was signed, the purchaser can get
out of the agreement. I was recently
informed that delivery is expected in
July 2007, past the 24 months
deadline. The problem is that in
March 2006 I signed an addendum
changing to Phase II of building
delivery from Phase I; however, the
addendum specifically states that it
''shall not change the Agreement in
any respect except as expressly
stated herein'' and does not explicity
change the date the original
agreement was entered into. Given
this, would I still be able to get out of
the contract if delivery is not until
after the date of the original
agreement?

Good Morning,
You raise an interesting question. I would want to see the original contract and addendum before fully responding. However, what was the status of Phase II in March 2006? It may be relevant if it could not be completed by July 2007.
