Legal Question in Real Estate Law in Virginia

I have a contract that has been defaulted on. Within the contract the payer is supposed to be responsable for legal fees. My lawyer didn't ask for fees will I get legal fees or will I pay my lawyer out of my pocket for his refusal to include them in his presentation to the court.

What matters with respect to this issue is whether these legal fees are referenced in the written

contract and allowed for under Virginia law and not what is "presented to the court".
