Legal Question in Real Estate Law in Virginia

Co-Signer on Rental Lease Agreement

I co-signed a rental lease agreement with my son-in-law 2 years ago. When the lease was up for renewal, he only signed it. My daughter and grandson have recently moved in with me while filing for divorce. My son-in-law stated that he cannot afford the rent without my daughter's support, so he is vacating short of 2 months til the end of the lease is valid. The landlord told me I will be responsible as a co-signer for any rent owed under the lease. I need to know what will happen next if my son-in-law does not pay the owed rent. Am I legally bound?

Re: Co-Signer on Rental Lease Agreement

It would be best for an attorney to review he lease. Nevertheless, if you did not sign the lease renewal, absent some language that the lease automatically renews, you should not be responsible after the first lease term.

Re: Co-Signer on Rental Lease Agreement

If you did not sign the lease renewal, you should have no responsibility for whatever delinquency your son-in-law incurs as a result of his nonpayment, as long as there's no language in the orignial lease allowing for renewal without your signature(or something to that effect).
