Legal Question in Real Estate Law in Virginia
Damming a creek
I would like to know the Virginia's policy on damming creeks, and after one dams a creek, the water ponds over on another's property, therefore creates water to flood their land, and destroy land by erosion. Isn;t there a law now in Federal court that no person may pond water over on another's property? What would they do to someone who has done this. Thank you.

Re: Damming a creek
There may be federal or state criminal penalties, but it is also a trespass and a nuisance, and the person whose property is harmed has the right to sue.
