Legal Question in Real Estate Law in Virginia
My daughter is a single mother of two small children. She rented a townhouse in a multi-family dwelling. They had new carpet when she moved in. Within a couple of weeks, as the summer was coming on, they noticed fleas hopping all over their legs and the children's socks. Then they were being bitten by the fleas. She called her landlord and he said that he wrote it in her lease that he would not be responsible for any "infestations." In Virginia state law is the landlord obliged to clean up infestations or is the landlord within his rights to do nothing knowing that the family is being eaten up by fleas? The youngest child, 2, has horrible reactions due ot allergy all over his body.

Your daughter may have the option of a tenant's assertion if the property is subject to the Virginia Landlord Tenant's Act.
