Legal Question in Real Estate Law in Virginia

Getting my name off a deed that my ex now owns

My ex(never married) and I bought a townhouse. I moved out in April 1998 and got my own apartment. Since he has never refinance and has been 7 months behind and almost $10,000 past due. They are about to start foreclosure proceedings. Since I had moved I never knew this until 2 weeks ago.

He is supposed to be refinancing now with his friend's mom to get my name off the deed. Is there anything I can do to protect myself and repair my credit with proof of my apartment and his admittance to me being innocent. Please let me know. I am a single mom struggling every since I moved out to support myself and my daughter.

Re: Getting name off a deed that ex now owns

You signed the loan documents, so you were obligated to pay. If he refinances and repays the whole loan, you will be off the hook for the money, but the credit reporting is still proper. If you want to put a note in your credit report, you can do that, but it generally makes no difference.

The problem is not the deed; it's the loan. You borrowed money, you have to repay it.
