Legal Question in Real Estate Law in Virginia
Early lease termination due to tenent illness
the roommate i am living with is causing me to relapse in an eating disorder due to her dieting behavior, comments about foods i eat, and such. my mental health professionals have mandated that i move out to preserve my health, or i may have to be readmitted to a hospital. my roommate however, is refusing to let me out of the lease or find a replacement to fill my spot for the last 2 months (the lease is up March 1, 2008 and i will be moving out jan. 4 2008). furthermore, she has failed to repair an electrical outlet in my room and the hall closet, has left outlet covers and switch plates off to expose wires without replacing them, and has not provided a fire detector in the apartment despite being asked by me and the fire marshal. Please help. do i have the right to get out of the lease, or at least find a replacement tenant?

Re: Early lease termination due to tenent illness
No, you do not "have the right to get out of the (sub)lease" without penalty unless the sublessor(your rommate) approves nor do you have the right to find a replacement for yourself on the sublease unless the terms of your subtenancy allow for this or that your sublessor also agrees to permit it.

No, you do not "have the right to get out of the (sub)lease" without penalty
unless your sublessor(roommate)approves of it nor to find a substitute for yourself on the sublease unless the terms of your subtenancy allow for this or your sublessor agress to permit it. (The foregoing assumes that your lease agreement is with the roommate and not the roommate's landlord.)
