Legal Question in Real Estate Law in Virginia

easement dispute power line

Virginia power has a 200 ft easement on my property for powerlines. Using a survey, I had a pool put on my property but they say it is in their easement by 3 feet and I must remove it. They say that their power line centerlines are always exactly 50 ft from the edge of the survey and the pool is only 47 ft from the center. What can I do?

You might want to talk with someone else higher up in the power company's hierarchy of management to see whether they'll cut you some slack on your encroachment into the utility's easement.

If such is not possible, then you'll

have to remove that part of the pool which encroaches upon their easement.

I also meant to add that if you comissioned the survey and it was done inaccurately such as to now cause you

unanticipated expense in having to move you pool, you may wish to consider bring suit against the folks who did the survey upon which you relied to position your pool.
