Legal Question in Real Estate Law in Virginia

Eviction in City of Alexandria

i am going to court for an eviction proceeding. i am behind two months rent (june and july). wanted to pay one month now, but rental community won't accept unless full payment of both months paid before date of hearing. cannot pay the 2nd rent until one week later. tried to work an agreement with rental office. they will not agree. i have been behind consistently due to new job and not making as much money. i do always pay rent, including late fees. any way i can have the judge agree to a payment and avoid eviction or any advice would be great. hearing is in three days.

Re: Eviction in City of Alexandria

Questions remain to be clarified such as whether

you have(or had) a written lease governed by the

common law statutory provisions or whether you're under the Virginia Residential Landlord Tenant Act(VRLTA), and when during the month is the payment actually due?

With the court date now so near, about all you

could do now is explain your situation

to the judge with an offer of immediate payment for June and the promise to pay for July in one week.(Your prior payment history may well determine the judge's decision.)
