Eviction

My husband and I have just lost our house at foreclosure sale 2 weeks ago. We've found a place to move to, but can't move in for another 2 weeks. The mortgage company's attorney sent us a letter saying that we have 5 days to get out. (The mortgage company bought the house back) Must we abide by this, or do they have to legally evict us? I'm having a hard time finding out about eviction in Virginia.

Hello,

I am sorry for your difficulty.

Failure to move out could add to any deficiency claim the lender may have. In other words, the difference between what you owe on the mortgage, plus costs, minus what the lender gets for the house at sale. You might be better off to have an attorney look at all the documents and perhaps an extension of two weeks can be agreed to, without increasing the costs.
