As executor of my mother's estate I do not want her home sold..nor does 2 of my brothers....I do however have another brother who wants his share of the real estate.and I am willing to buy out his share.....is it my responsibility as executor to pay for an appraisal since I am not the one that wants the home sold or can I go by the yearly tax assessment done by our county to come to an agreement with him as to the value of the real estate? I have not ask him to contribute his 1/4th share of any expenses I have incurred since my mother's death and I feel since he is the one that wants his share he should be responsible for the appraisal..am I within the law for asking him this?

When your brother sues in equity in circuit court for partition and sale of the property, you can then present, as part of your evidence, the county's yearly tax assessment based upon their valuation of the property.
