fallen tree removal

In a recent hurricane, a healthy tree of mine fell onto my neighbor's fence. My insurance company tells me that the cost of removing the tree is my neighbor's responsibility, not mine. My neighbor is demanding that I remove the tree or pay his insurance deductible. Who needs to pay to remove the fallen tree?

If the tree was apparently healthy and its fall was due to an unforseeable "Act of God",i.e., the hurricane, I believe that your insurance company is correct in its opinion as to who is responsible for the cost of removing the tree and paying for any damage occasioned by its fall.
