my neighbor put up a fence 3 feet on my property years ago and it fell into disrepair and he removed it ,about a year later he put up another one without my permission,i want it removed what can i do if he refuses

You might want to have that area of
your property resurveyed before you send the neighbor written notice that he must remove the offending fence by a date certain or that you'll have it taken down.
And, then, if that date comes and goes,
with no removal of this structure which the resurvey has clearly shown to be occupying your land, you'll know what to do.
