Legal Question in Real Estate Law in Virginia
We have a fence between our yard and the neighbors yard that was installed before either of us purchased our homes. The fence was obviously put up by the previous owners of our home because their fence ties into the side of our fence. It is a nice rail fence with wire to keep animals in/out. They want to keep items in their backyard that are against the HOA rules (car & trailer) so they decided that they want to put up a privacy fence. Are we legally obligated to help pay for a privacy fence when a perfectly good fence is already in place?

No, I would think not, particularly where the purpose of this
fence apparently is to allow these neighbors to circumvent
compliance with HOA rules.
