Legal Question in Real Estate Law in Virginia
We filed chapter 13 bankruptcy to stop foreclosure in 2006. Our automatic stay was lifted recently because we feel behind on our payments. Now we are in foreclosure and the mortgage company won't work with us. I recently got a part time job and paying the mortgage isn't a problem. We were foreclosed on and then received a letter from the mortgage company saying that their were options. When we called, they said that our only option was to pay $5000. We have filed for HAMP, but I don't know what happens with that. We would love to keep our home and wondered if you could give us any advice. The lawyer for Indymac bank said that they couldn't produce the original note at the time they were asked to foreclose. With Indymac failing, I am wondering if they really still own my loan or if someone else does. Can you tell me if I have any oiptions, or if I shoudl just give up. Thanks so much
