Legal Question in Real Estate Law in Virginia

My friend fell 3 months behind mortgage payments and called an Ad in a local newspaper,a forecloser rescue compamy.They convinced her that she would have to sign some papers in Order for them to help her.She signed over Title, Lease Agrement, and a Special Power of Attorney and they explain to her they would handle all the back payments and for her to make all mortgage payments too them.

The back payments were and still have not been paid yet the Lease Agrement is for $400 a month.

Now I am from another state but enjoy Title Searching and too my dismay found the only document recorded was the change in Title and also found that the closing Attorney is the Owner of the company who holds Title.

My question is: Is this a case of Conflict of Intrest in your state?

What if any re-course of action does she have?

Conflict of interest, you query? How about outright fraud and theft. Your friend

would appear to have already lost her home to these scammers and fraudsters and would be well advised to notify local law enforcement authorities and arrange

to see an attorney in regard to initiating a civil suit for anything that she still might

recover.
