Legal Question in Real Estate Law in Virginia

How does my friend get her name off a mortgage and deed w/out consent by the other party? Is there anyway for this to happen. They can't refinance, she doesn't even live there, he is going to jail for a long time today. She doesn't want this to hurt her credit.

Your friend could file a petition in the circuit court where

the property is located for a partition of the property and in lieu

thereof a judically-ordered sale and appropriate division of the proceeds from this sale to the parties. Otherwise, under the facts described,

she is likely to remain obligated for the property.
