Legal Question in Real Estate Law in Virginia

Gas log fireplace

Bought a house and the gas log fireplace has a hole in the gas line. Contaced both the selling agent and my agent. The selling agent said he was not going to pay...who is responsible?

Thank You

Diane

Re: Gas log fireplace

Without more facts, it's difficult to say. In Virginia the seller of real estate is not legally obligated to disclose material defects to

the buyer---unless he or she is specifically asked about a particular item or items. Only then are they required to answer truthfully (to the best of their knowledge) regarding the items in question in order to avoid a charge of fraud.
