Legal Question in Real Estate Law in Virginia

golf liability`

I hit a errant golf shot and broke a window on a house on the course. Does the home owner assume the risk since the golf course was there before their house was built?

No, if you caused the errant golf ball to break the window on the house, you're responsible for paying for the damage to repair it. (Assumption of the risk is not a viable defense to a charge of negligence in this type of situation--in my opinion.)
