Legal Question in Real Estate Law in Virginia
Hi,
I have recently purchased a foreclosed home in Newsoms, Virginia on land containing 0.92 acre. I was always aware that situated next to this was another plat of land of same dimensions with a mobile home situated on it. I received my title deeds to property and unknowingly it conveyed the land next to mine as well, however, the previous owner is listing it for sale. He disputes that it was not recorded correctly, but all legal latest title, survey done etc, has my name by ownership. Could he somehow claim it back even there was an error on transfer?

Yes, the gentleman who actually owns this parcel of land adjacent to the one you recently purchased
may have to file a lawsuit in the circuit court in the area where this property is located to clear the cloud that apparently has been created through errors associated with the workup of the legal paperwork associated with your conveyance and its erroneous recordation in the land records division of the local circuit court.
And whoever may be responsible for creating this situation through their errors that may necessitate
the above described suit to quiet title could also be liable in civil damages to the rightful owner of
this property for his legaL expenditures in having to now clear its title through costly court action.
