Legal Question in Real Estate Law in Virginia

HOA by Association

3 years ago, we moved to an established neighborhood without a home owner's association. We had been in one at our last house & do not think highly of them. One of our neighbors mailed a request for meeting to the neighborhood suggesting we establish a HOA. My questions are:

1. Can one be established without my consent?

2. Would I be legally bound to participate monetarily or otherwise, if they choose to establish one without me?

Good Morning,

Before answering your question, I would want to see your deed for any possible covenants or other possible matters of record. Generally speaking, if your neighbors are just neighbors and there are no obligations in common, there cannot be a "forced" home owners association.
