Legal Question in Real Estate Law in Virginia

home on wrong land

I recently purchased a modular home and land. The seller of the home hired all contractors to perform all work on the land and home installation. The home was placed on the land without consulting me as to where the house was to go and now constuction has stopped since the company has found out the home was placed on the wrong land. The home was placed approximately 50' past my property line. They are trying to say that it is my fault since we initially walked through the land before the clearing was done and discussed where we thought the house should go. Now they are assuming that I should have to pay for the land that the house is on, provided the land owner will sell. What are my legal options to ensure that I am protected and that I do not get sued from the other property owner, as well as not sinking another penny into this venture.

Assuming that you have no desire to purchase the land where the house now sits, the structure will have to be removed from its current situs.

As to whom is responsible for this error and should have to pay for the cost of correcting it, an attorney would most likely need to review the terms of your purchase conract and advise you, accordingly,
