Legal Question in Real Estate Law in Virginia

homeowner associations responsibilities

our community of townhomes is still under construction, however the home builders have went bankrupt and the complex will not be completed. the homeowners assoc. takes the money but since we are not an assoc yet our moneys are virtually out there and they do not answer questions or do anything for the area. what can our community do to legally regain control of our investments or force our current hoa to act reponsibly. petetions have been completed with 100% support of some kind of action. please help thanks
