House concern

I am having a new home built. After the framing and sheet rock were done we found out we had a leak coming in from the chimney. They finished the vinyl siding up on the peak and sealed the chimney. During the next big storm it leak (not as much and took a long time for it to come inside) again. So they checked the roof around & resealed again. They think it is fixed and are moving on. Is there something I can do at closing to cover myself so if there still is a leak I am not liable for that? Also does a new construction home come with a warranty of 1yr mandatory?

Amend the contract to provide for the builder's responsibility to fix the problem if it occurs within some reasonable time in the future.

Your applicable warranty will most likely be whatever the contract provides for in this regard.
