Legal Question in Real Estate Law in Virginia

I own a house with my ex girlfriend and I want out. She put $50K as a downpayment. The assessed value is down. She does not want to sell the house for fear of losing $. How can I get out of this awful situation? Can I at least rent my bedroom? She is considering refinancing to take full ownership however she is requesting the downpayment she put in be reimbursed by me. Is this fair?

A refinance on the part of your girlfriend, her buyout of your interest in

the property, or a suit to partition in the circuit court which likely would result in a judicially ordered sale are your options.

As I've repeatedly warned in this forum in the past, buying property with other

people to whom you're not married is generally a prescription for

future trouble (and an expensive one at that----particularly in a declining

housing market).

And, yes, in the meantime, as a co-owner of the property, you're

entitled to rent out your bedroom.
