Legal Question in Real Estate Law in Virginia

My husband has Alzheimers and at some point he may have to go into a nursing home. I would like

to know if I put our homes in my name, can a nursing home come in and make me sell them to

pay for his care?

No, not the nursing home but the state Medicaid agency charged with recovering

costs may pursue you if the cost of the nursing home care is being paid for

under Medicaid. (The so-called "look back" period in which transfers of property

owned by Medicaid recipients may occur and be reversed in favor of the state is around five years or so.)

Consult an attorney who specializes in elderlaw issues for further

advice on this particular matter.
