Legal Question in Real Estate Law in Virginia

My husband and I are being sued with a warrant in detinue. Last year the same people filed a warrant in detinue against us but then non-suited us. This time, they have added other items and have deleted others from the previous warrant in detinue. We would like to know if we can countersue them for defamation of character because the things they are claiming were taken were not only returned, but the other items were never taken or seen by us ever. What do we do?

You can't sue for defamation based on statements made in court pleadings or in court.
