Legal Question in Real Estate Law in Virginia

My husband's parents house is being sold, the realestate lawyer my husbands brother hired pulled up a personal loan for a car that he owned back in 1996 or 1997. the car was totaled and my husband did not have gap insurance. it has now come up that a bank central fidelity which is no longer in exsistance has a lien on his parents house for 863.00, central fidelity sold out to wachovia and wachovia says they have no record of this loan. what can we do to get this taken care of. this does not show up on a credit report nor has anyone tried to contact him in 10 years to try and settle this.

what can we do at this point?

Under these circumstances, your husband could petition the court which entered the judgment against him to have it vacated if no claimant can be found to pay the money to in order to have the lien released.
