Legal Question in Real Estate Law in Virginia

jointly owned property after the divorce

My former wife and I still jointly own a time-share that we purchase while married. The was no property settlement at the time of the divorce. There are annual fees of nearly $500. I am unable to afford this or use of the time-share. I would like to sell the time-share, pay the unpaid annual fees, and split any profits. I do not know where my ex-wife is at this time, she may have left the state. How I resolve this?

Re: jointly owned property after the divorce

Your most economical approach is likely to continue to search for your wife's whereabouts utilizing the resources of the Internet "People Searchers" type programs as well as your wife's relatives as possible sources of information concerning her current location. Whenever she's located, you should immedately get her sigature on a sale agreement conveying her share of the timeshare to you in return for whatever dollar consideration is appropriate.

Otherwise, you're likely looking at some kind of action with an attorney in the circuit court to divest your wife of her share of ownnership which could end up costing more than what the timeshare is currently worth.

Correction: Prior answer should reference "former wife" as opposed to "wife".
