judgement

I received recently a letter advising me of a judgement rendered in favor of the Eagle Trace Homeowners assoc. in the amount of 2629.45 on a time share that was a voluntary foreclosure. I was never notified in writing or in any other form that a judgement was being filed and as a result I was never given a chance to reply or to be present at the hearing if there was one! I need to know if the proceeding was legal and what can I do now to get this off of my credit record?

You should have been served a summons by Eagle with a copy of the complaint attached. The court, after receiving notice from Eagle that the summons and complaint was served on you, should have then sent you notice of the trial date. It may be moot by now, but you may wish to check any unanswered mail. Also, go to the courthouse and have the clerk pull the file and check to see when you were served with the complaint and summons.

At this point, the only way to remove the judgment from your records is to pay it and provide the credit reporting agencies with verification that the judgment was paid.
