Legal Question in Real Estate Law in Virginia

Land Lord wrong??

My lease ended 31 January, 2007. However, I still had some of my possessions in this house. Yesterday he had two men come over and take my stuff out of the home and leave most of it in the driveway. The rest they took for themselves. Is this legal.

Re: Land Lord wrong??

If your lease was governed by the Virginia Residential Landlord Tenant Act(VRLTA)and in your notice of lease termination you were given the required notice that you would have only 24 hours after termination of the lease to remove any items of personal property left in or on the leased premises or they would be considered

abandoned and subject to the landlord's disposal as he might see fit(See Va Code Sec. 55-248.38:1), then the answer to your question must necessarily be, yes, your property was apparently disposed of in a legally acceptable manner.

If your lease, however, was not covered by the VRLTA, then the disposal of your property would likely have been governed by a provision in this lease, or in the absence of such provision, by the common law governing such property left in a formerly leased premises, which would've given the landlord basically the same right to dispose of it as you've already described.
